Text messaging is available on most digital handsets. Each message is limited to 150 characters. Message delivery will be attempted for up to 14 days from the date of receipt by CellularOne after which the message will be deleted from the system. Charges apply to all messages sent whether read or unread. You may cancel this service by notifying CellularOne. You will be billed for usage up to cancellation.

Like voice messages on wireless systems, text messages may be garbled or lost due to circumstances that are hard to verify and often beyond the control of CellularOne. For this reason CellularOne cannot guarantee a message will be received, or if received that it will be read. BY AVAILING YOURSELF OF TEXT MESSAGING, YOU AGREE THAT CELLULARONE SHALL HAVE NO LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER THAT MAY ARISE FROM USE OF TEXT MESSAGING, INCLUDING WITHOUT LIMITATION LOSSES ARISING BECAUSE MESSAGES HAVE BEEN LOST, DELAYED OR DISTORTED.

As is the case with voice messages transmitted over wireless facilities, the privacy of wireless text messages cannot be guaranteed. Messages may be intercepted by unauthorized third parties, or may be passed on by the intended recipient. IF YOU REQUIRE A GUARANTEE OF PRIVACY FOR YOUR MESSAGE, YOU SHOULD NOT USE THIS SERVICE.

CELLULARONE MAKES NO EXPRESS WARRANTY REGARDING THE SERVICE AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CELLULARONE DOES NOT AUTHORIZE ANYONE TO MAKE A WARRANTY OF ANY KIND ON ITS BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT.
